If you or your clients are reducing hours for employees, have employees requesting leave as part of COVID-19, or are exploring layoffs, there are important implications you need to be aware of under the Affordable Care Act (ACA) §4980H.  

 

Employers using the look-back measurement method under the ACA may experience some unexpected impacts for employees who request leave or whose hours are temporarily reduced due to COVID-19. It may also affect employees who are terminated from employment and later rehired.
